Licence agreement

By installing or using this software you agree to this licence. If you do not agree, do not install or use it.

1. "We" are Jonny Reckless, trading as Reckless Technology, in California, USA. "You" are the person or organisation using this copy. "The Software" is the Reckless Technology plugins in every format, their user guide, presets and updates.
2. The Software is free. You may install it on as many computers as you like and use it for any purpose, personal or commercial. What you make with it - audio, presets, impulse responses - is yours, royalty-free.
3. You may not sell or rent the Software, offer it for download anywhere but recklesstechnology.com - point people there instead - modify it, reverse engineer it (except where the law allows), or remove its notices. It is licensed to you, not sold; we and our licensors own it.
4. The Software contains other people's software, used under the licences THIRD-PARTY-NOTICES.txt reproduces; nothing here limits the rights they give you. Files you load into the Software belong to you or their authors.
5. The Software collects no personal data. Once a day, while a plugin's window is open, it asks recklesstechnology.com whether a newer version is out - one request for a small file, carrying the version you have and nothing about you or your computer, though the website's host sees the address it comes from, as for any web page - and says so in the plugin's header if one is. It never downloads or installs anything itself; turn the check off with Updates > Check automatically in the settings gear's menu. Otherwise it goes online only when you ask: the Reckless NAM's TONE3000 browser, once you sign in, connects to tone3000.com under TONE3000's own terms, each capture there under its creator's licence. Your sign-in stays on your computer until you sign out.
6. THE SOFTWARE IS PROVIDED FREE OF CHARGE AND "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT, TO THE FULLEST EXTENT THE LAW ALLOWS. WE ARE NOT LIABLE FOR ANY DAMAGES ARISING FROM ITS USE OR FROM BEING UNABLE TO USE IT - INCLUDING LOST PROFIT, BUSINESS OR DATA, AND ANY INDIRECT, INCIDENTAL OR CONSEQUENTIAL LOSS - TO THE FULLEST EXTENT THE LAW ALLOWS. SOME PLACES DO NOT ALLOW THESE EXCLUSIONS, SO SOME OF THEM MAY NOT APPLY TO YOU.
7. You may end this licence by deleting the Software. We may end it if you break it and do not put that right within 14 days of our asking; you must then delete the Software.
8. This licence is governed by the laws of the State of California, USA.
9. Reckless Technology, its plugins' names and its logo are our trade marks. VST is a registered trademark of Steinberg Media Technologies GmbH. ASIO is a registered trademark of Steinberg Media Technologies GmbH.
